Terms of Use

These terms cover the Calio iPhone app, its Apple Watch companion, and the getcalio.com website, provided by Tristan Jarrett. By using Calio or the website, you agree to these terms. Our Privacy Policy explains how data is handled. If you do not agree, do not use Calio or the website.

Apple’s Standard EULA

The Calio app is licensed, not sold. Because Calio uses Apple’s Standard EULA in all countries and regions where the app is offered, your use of the app downloaded from the App Store is governed by Apple’s Licensed Application End User License Agreement (the Standard EULA). Calio is not providing a custom EULA. The Standard EULA includes the rules for the app license, permitted use, technical data, termination, external services, warranties, and liability. These website Terms of Use are supplemental: they govern your relationship with Tristan Jarrett concerning getcalio.com, the Calio food service, and other services we provide, to the extent those matters are not governed by Apple’s Standard EULA.

Apple’s terms govern your relationship with Apple, the App Store, your Apple Account, and Apple’s payment and subscription systems. If a mandatory law or an applicable Apple term conflicts with these terms, that mandatory law or Apple term controls to the extent of the conflict.

Calio is not medical advice

Calio is a self-tracking tool for general wellness. It is not a medical device and does not give medical, nutritional, or dietary advice. The calorie and macro targets it calculates are estimates based on standard formulas and the details you enter, and may not be right for you. Calio is not intended to diagnose, treat, cure, or prevent any disease, and is not for emergencies.

Calio AI can answer short questions about food and eating with general information, such as common guidelines for protein or fiber. Its answers are not personal advice: Calio AI does not know your health, weight, or goals, and its answers can be wrong.

Talk to a doctor or registered dietitian before changing your diet, particularly if you are pregnant, under 18, have a medical condition, take medication, or have a history of disordered eating.

Nutrition data

Food information comes from USDA FoodData Central, Open Food Facts, manufacturers, and foods people enter themselves. We do not verify every entry and cannot guarantee that nutrition information is accurate, complete, or current. Check the packaging where it matters, especially for allergens. You are responsible for the food choices you make using Calio.

Using the website and Calio services

Subject to these terms and the Standard EULA, we permit you to access getcalio.com and use the Calio food service for your personal, non-commercial use. The app license itself comes from Apple’s Standard EULA. You must use the Apple Watch companion only with a compatible copy of Calio. We reserve all rights not expressly granted.

What you agree not to do

• Copy, resell, rent, sublicense, redistribute, or commercially exploit Calio or the website except as permitted by law and the Standard EULA.
• Scrape, overload, circumvent access controls, or otherwise abuse the food service.
• Use Calio AI in any way the fair use policy below does not allow.
• Use Calio to upload or transmit unlawful, infringing, harmful, or malicious material.
• Use Calio for anything unlawful.

Your content

What you enter or create in Calio stays yours. Because it lives on your devices and, when enabled, in your private iCloud, you are responsible for keeping backups and for anything you choose to export or share. We hold no copy of your diary and cannot restore it. You can export selected data from inside the app, but you are responsible for the recipients and services to which you send an export.

Our content

The Calio software, website, original visual design, icon, text, and other materials are owned by Tristan Jarrett or used under license. Those materials may be protected by copyright and other applicable laws. “Calio” is a brand name used by us; nothing in these terms claims that it is a registered trademark. Nothing here transfers any of those rights to you. USDA FoodData Central and Open Food Facts data remain subject to their own licenses and terms. The restrictions above on personal use, copying, redistribution, and commercial use do not limit rights granted by those open-data licenses, including the right to reuse Open Food Facts data under the Open Database License (ODbL) 1.0. Third-party services

Calio works alongside services we do not control, including Apple iCloud, CloudKit, HealthKit, StoreKit, Cloudflare, OpenAI, USDA FoodData Central, and Open Food Facts. Their own terms, licenses, availability, and privacy practices apply to those services. Nutrition results may be incomplete, inaccurate, unavailable, or changed by their providers.

Availability

We may change, suspend, or discontinue Calio, the website, the food service, or any feature at any time, and will update the app to keep it working with new versions of iOS where reasonably practicable. We aim to keep the food service available but do not promise uninterrupted or error-free service. Apple, Cloudflare, and the public nutrition providers may also change or restrict their services.

Calio Pro and purchases

Calio is free to use for logging food, water, weight, and workouts, viewing your diary, using food search and barcode lookup, and using the available iCloud, Apple Health, widget, and Apple Watch features. Calio Pro is an optional upgrade that unlocks the top-sources breakdown, goals for every nutrient Calio tracks, an unlimited recipe library, exports covering any date range, and everyday AI meal logging within the fair use policy. Free users get a small number of AI chats, shown in the app; a chat is used when Calio AI first answers it. Calio AI uses OpenAI to read meal descriptions and photos, and its results can be wrong; check foods and amounts before adding them. Pro features may change as the app changes; nothing already logged is deleted merely because Pro ends.

Calio Pro is sold either as an auto-renewing subscription (weekly, monthly, or yearly) or as a one-time Lifetime purchase. Prices, taxes where applicable, and subscription details are shown by Apple and in the app before you buy. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends, and your Apple Account is charged for the renewal within 24 hours of the period ending. You can view, change, or cancel a subscription at any time in Settings on your device, under your Apple Account subscriptions. Deleting the app does not cancel a subscription.

A subscription may begin with a free trial. The length of the trial and the price that follows it are shown in the app and by Apple before you start. Free trials are offered once per Apple Account, and only to accounts that have not already used one for Calio Pro. When the trial ends, the subscription starts and your Apple Account is charged, unless you cancel at least 24 hours before the trial ends. You can cancel during the trial in the same place you manage any subscription, and you keep Pro until the trial period is over. Changing plans during a trial may end the rest of it, under Apple’s rules.

All purchases are processed by Apple under Apple’s applicable media services terms. Refunds are requested through Apple rather than from us. If Pro ends or is refunded, nothing you have logged is deleted: recipes, goals, and history you already created stay on your devices, and the Pro features simply stop being available. Buying Lifetime does not cancel an active subscription; you must cancel that subscription through Apple if you no longer want it to renew. Restore is available for purchases associated with the same Apple Account, subject to Apple’s systems and rules.

Fair use of Calio AI

Calio AI is for logging the meals you eat and asking short questions about food. Every message is read by a paid AI service, so its use has limits that keep it quick and affordable for everyone. Calio Pro includes everyday use of Calio AI; it does not include unlimited use.

• Each installation of Calio can send a set number of Calio AI messages a day, with or without Calio Pro. The Calio AI menu in the app shows how many are left. A day starts at 6:00 AM UTC.
• Calio Free includes a small number of AI chats, shown in the app. A chat is used when Calio AI first answers it, and a free chat can be continued for a limited time and number of messages.
• Calio AI has a daily capacity shared by everyone using it. On a very busy day it may pause until the next day starts. Food search, barcode scanning, and logging by hand keep working.
• We may change these limits at any time, including without an app update, to keep Calio AI working well. The app shows the limits that apply to you.

When you use Calio AI, you agree not to:

• Use it for anything other than logging food you eat or plan to eat, or asking about food and eating.
• Send it content unrelated to meals, or content meant to change how it behaves.
• Automate requests, share or resell access, or use it on behalf of others as a service.
• Try to get around its limits, for example by reinstalling Calio to reset free chats.

We may limit or suspend Calio AI for an installation that does not follow this policy. The rest of Calio keeps working, and anything already logged stays yours.

No warranty

Calio, the website, and the food service are provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We do not promise that they will be accurate, secure, uninterrupted, or fit for a particular purpose. This section does not limit warranties or rights that cannot lawfully be excluded.

Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, business, opportunity, or data, arising from your use of or inability to use Calio or a third-party service. Nothing here excludes or limits liability or statutory rights that cannot lawfully be excluded or limited, including applicable consumer protection rights.

Changes

We may update these terms as Calio changes. The date at the top always reflects the current version, and continuing to use Calio or the website after an update means you accept the updated terms to the extent permitted by law.

Governing law

These terms are governed by the laws of Canada, as applicable in the Province of Ontario, without regard to conflict-of-law rules. The courts located in Ontario have jurisdiction over disputes, except that a consumer may have the right under mandatory local law to bring a claim in another forum. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
